Asylum is a form of protection granted to individuals who have been persecuted or fear they will be persecuted on account of their race, religion, nationality, membership in a particular social group, or political opinion. To apply for asylum affirmatively or defensively, file a Form I-589, Application for Asylum and for Withholding of Removal, within 1 year of your arrival to the United States.

There are three ways of obtaining asylum in the United States: The affirmative process; An Asylum Merits Interview after a positive credible fear determination; or The defensive process.

The affirmative process is for people who are not in removal proceedings. You must submit your application within one year of your last arrival in the United States unless you can show changed circumstances that materially affect your eligibility for asylum or extraordinary circumstances relating to the delay in filing.

The defensive process is for people who are already in removal proceedings. You may apply for asylum defensively at any time during your removal proceedings.

An Asylum Merits Interview after a positive credible fear determination is for people who are subject to expedited removal and found to have a credible fear of persecution or torture..
